1. Introduction

Welcome to Saral Pooja.

These Terms and Conditions ("Terms") govern your access to and use of the Saral Pooja mobile application, website, and all related services offered through the Platform. By accessing, registering, or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with any part of these Terms, you must not access or use the Platform.

Saral Pooja is an online platform that enables users to discover, book, and manage religious and spiritual services, including pujas, pandit bookings, temple services, spiritual consultations, devotional offerings, and any additional services introduced from time to time.

These Terms form a legally binding agreement between you and Saral Pooja. They explain your rights and responsibilities, our responsibilities, the rules governing the use of our Platform, payment procedures, cancellations, refunds, dispute resolution, and other important legal matters.

Your use of the Platform is also subject to our Privacy Policy, Refund Policy, Account Deletion Policy, and any additional policies published by Saral Pooja. By using the Platform, you agree to comply with all such policies as they may be updated from time to time.

We reserve the right to modify these Terms whenever necessary due to changes in our Services, technology, legal requirements, or business practices. Any updated version will be published on the Platform with a revised "Last Updated" date. Your continued use of the Platform after such changes become effective constitutes your acceptance of the revised Terms.

2. Definitions

For the purposes of these Terms, the following words have the meanings assigned to them below.

"Saral Pooja," "Company," "we," "our," and "us" refer to the owner and operator of the Saral Pooja Platform.

"User," "you," and "your" refer to any individual or entity that accesses, browses, registers, or uses the Platform.

"Platform" means the Saral Pooja mobile application, website, customer support channels, and any other digital services operated by the Company.

"Services" means all religious, spiritual, devotional, and related services made available through the Platform, including services that may be introduced in the future.

"Pandit" means a verified priest, spiritual guide, astrologer, temple representative, or any other service provider registered or engaged through the Platform to provide religious or spiritual services.

"Booking" means a request placed by a user for any service available on the Platform.

"Order" includes any confirmed booking, purchase, subscription, donation, or transaction completed through the Platform.

"Content" means all text, images, graphics, logos, videos, audio, software, icons, trademarks, designs, and other material displayed on the Platform.

"Applicable Law" means all laws, rules, regulations, notifications, and governmental requirements that apply to these Terms and the Services provided by Saral Pooja.

3. Eligibility

You may use the Platform only if you are legally capable of entering into a binding agreement under the laws applicable to you.

If you are under the age required to enter into a legally binding contract, you may use the Platform only under the supervision and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

By using the Platform, you represent and warrant that the information you provide is true, accurate, complete, and up to date. You agree to update your information whenever necessary to ensure its continued accuracy.

Saral Pooja reserves the right to suspend, restrict, or terminate access to the Platform if we reasonably believe that false, misleading, or incomplete information has been provided or that these Terms have been violated.

4. Acceptance of Terms

By creating an account, booking a service, making a payment, browsing the Platform, contacting customer support, or otherwise using any feature of Saral Pooja, you agree to be legally bound by these Terms.

These Terms apply to all users of the Platform, including visitors, registered users, customers, and verified service providers where applicable.

If any part of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions will continue to remain in full force and effect.

5. Scope of Services

Saral Pooja provides an online technology platform that facilitates the discovery, booking, coordination, and management of religious and spiritual services.

Depending on availability, the Platform may offer services such as home pujas, temple pujas, online consultations, pandit bookings, religious ceremonies, festival-related services, devotional content, religious products, charitable donations, subscriptions, and other services introduced in the future.

While Saral Pooja strives to ensure a smooth and reliable experience, the availability of specific services may vary depending on factors such as location, timing, service provider availability, festivals, weather conditions, public holidays, government restrictions, and other circumstances beyond our reasonable control.

We reserve the right to modify, suspend, discontinue, or introduce any feature or service at any time without prior notice where reasonably necessary for business, operational, technical, or legal reasons.

6. User Account

Certain features of the Platform require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out using your account.

You agree not to share your account with any other person or allow unauthorized access to your account. If you believe your account has been compromised or used without your permission, you must notify Saral Pooja immediately.

We may suspend or terminate your account if we reasonably believe that it has been used for fraudulent activities, illegal purposes, unauthorized access, abuse of the Platform, or violation of these Terms.

You are responsible for ensuring that the contact information associated with your account remains accurate and up to date so that we can communicate important information regarding your bookings and account.

7. User Responsibilities

By using the Saral Pooja Platform, you agree to use the Services responsibly, honestly, and in accordance with these Terms and all applicable laws. You are responsible for ensuring that the information you provide during registration, booking, or communication with us is accurate, complete, and up to date.

You agree to provide correct booking details, including the location, preferred date and time, contact information, and any other information required to perform the requested religious service. Saral Pooja shall not be responsible for delays, failed bookings, or additional costs resulting from incorrect or incomplete information provided by you.

You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out using your account. If you suspect any unauthorized use of your account, you must immediately notify Saral Pooja so that appropriate action can be taken.

You are also responsible for ensuring that the location where a home puja or other service is to be performed is safe, accessible, and suitable for the requested service. Any special requirements should be communicated to us during the booking process.

8. Acceptable Use of the Platform

Saral Pooja is intended to be used only for lawful and genuine purposes. You agree not to misuse the Platform or engage in activities that may interfere with its operation or affect other users.

While using the Platform, you must not:

• Use false or misleading information.
• Create multiple accounts for fraudulent purposes.
• Attempt to gain unauthorized access to our systems, servers, or user accounts.
• Upload viruses, malicious software, or harmful code.
• Disrupt the operation, security, or performance of the Platform.
• Impersonate another individual or organization.
• Use abusive, offensive, threatening, discriminatory, or defamatory language while interacting with customer support, pandits, or other users.
• Engage in illegal, fraudulent, or deceptive activities.
• Attempt to reverse engineer, copy, modify, or exploit any part of the Platform without our written permission.
• Use the Platform in any manner that violates applicable laws or regulations.

Saral Pooja reserves the right to suspend or permanently terminate any account that is found to be involved in misuse, fraud, abuse, illegal activities, or repeated violations of these Terms.

9. Booking of Services

Saral Pooja allows users to book various religious and spiritual services through the Platform. A booking request does not automatically guarantee confirmation. A booking becomes confirmed only after successful payment (where applicable), availability of the selected service, and confirmation from Saral Pooja or the assigned service provider.

After a booking is confirmed, you will receive confirmation through the Platform, SMS, email, WhatsApp, or any other communication channel made available by Saral Pooja.

You are responsible for reviewing your booking details before confirming your order. If you notice any errors, you should contact customer support as soon as possible. While we will make reasonable efforts to assist you, modifications may not always be possible once a booking has been confirmed.

Certain services may require advance preparation, religious materials, travel arrangements, or scheduling with service providers. Accordingly, booking timelines may vary depending on the type of service requested.

Saral Pooja reserves the right to refuse or cancel a booking if we reasonably believe that the booking violates these Terms, involves fraudulent activity, contains incorrect information, or cannot be fulfilled due to circumstances beyond our reasonable control.

10. Availability of Services

Our Services are offered subject to availability. Availability may depend on several factors, including the location of the service, availability of verified pandits, festivals, weather conditions, public holidays, travel restrictions, or other operational circumstances.

While we make every reasonable effort to fulfill confirmed bookings on time, there may be situations where a scheduled service needs to be rescheduled, reassigned, or cancelled due to unavoidable circumstances.

If a service cannot be provided as scheduled, Saral Pooja will make reasonable efforts to offer an alternative time, assign another qualified service provider where appropriate, or process a refund in accordance with our Refund Policy.

We do not guarantee uninterrupted availability of every service listed on the Platform, and new services may be introduced or existing services may be modified or discontinued from time to time.

11. Responsibilities of Pandits and Service Providers

Saral Pooja works with verified pandits and service providers to deliver religious services through the Platform. We make reasonable efforts to verify their identity and maintain service quality. However, individual pandits and service providers remain responsible for the manner in which they perform their services.

Pandits are expected to conduct themselves professionally, respectfully, and in accordance with applicable religious practices. They are also expected to arrive at the agreed location and time, subject to reasonable delays caused by circumstances beyond their control.

Users are expected to treat pandits and service providers with courtesy and respect. Any abusive, threatening, discriminatory, or inappropriate behaviour towards a pandit or service provider may result in cancellation of the booking, suspension of the user account, or other appropriate action.

Saral Pooja does not endorse any personal opinions, spiritual advice, or individual interpretations expressed by pandits unless expressly stated by the Company. Religious practices may vary depending on traditions, regions, and individual customs, and users acknowledge that such differences do not constitute a defect in the service.

12. User Conduct During Services

Users are expected to cooperate with pandits and service providers to ensure the successful completion of the booked service.

You agree not to engage in behaviour that is abusive, threatening, violent, discriminatory, unlawful, or otherwise inappropriate during the performance of any religious service.

You must ensure that the service location is reasonably safe and accessible. If a pandit reasonably believes that the environment is unsafe or poses a risk to health or safety, the service may be discontinued without liability to Saral Pooja.

Users must not request or encourage any activity that violates applicable law, public policy, or accepted standards of public safety.

If any dispute arises during the performance of a service, users are encouraged to contact Saral Pooja's customer support so that the matter can be reviewed fairly and appropriate assistance can be provided.

13. Pricing and Payments

The prices displayed on the Saral Pooja Platform are determined based on the type of service selected, the location, the duration of the service, materials required, travel expenses (if applicable), applicable taxes, and other relevant factors. All prices shown on the Platform are in Indian Rupees (INR) unless otherwise specified.

The total amount payable for a booking will be displayed before you confirm your order. By proceeding with the payment, you agree to pay the total amount shown, including any applicable taxes, convenience fees, platform fees, or other charges that are clearly disclosed during the booking process.

Saral Pooja reserves the right to update or revise prices at any time. Any change in pricing will not affect bookings that have already been confirmed unless the booking is modified at the request of the user.

Payments can be made using the payment methods supported on the Platform from time to time, including UPI, debit cards, credit cards, net banking, digital wallets, or any other approved payment method. All payments are processed through secure third-party payment gateways. Saral Pooja does not store your complete card details, UPI PIN, CVV, or other sensitive payment credentials.

A booking will generally be treated as confirmed only after successful payment or successful completion of any payment process specified for that particular service.

If a payment fails due to network issues, banking errors, insufficient balance, technical problems, or reasons beyond our control, the booking may not be confirmed until the payment is successfully completed.

14. Taxes and Invoices

Where applicable, the prices displayed on the Platform may include Goods and Services Tax (GST) or other taxes required under applicable law. In some cases, taxes may be shown separately before the payment is completed.

After successful payment, Saral Pooja may provide a payment confirmation, receipt, invoice, or tax invoice through the Platform, email, WhatsApp, or any other official communication channel.

Users are responsible for verifying the accuracy of their billing information before completing a transaction. If an invoice requires correction due to inaccurate information provided by the user, Saral Pooja will make reasonable efforts to assist where legally and operationally possible.

15. Cancellation of Bookings

Users may request cancellation of a booking through the Platform or by contacting our customer support, subject to the applicable cancellation policy for the booked service.

The cancellation terms may vary depending on the type of service, the scheduled time of the booking, the preparation already completed, travel arrangements made by the service provider, procurement of puja materials, or other operational considerations.

If a cancellation request is received sufficiently in advance and before significant preparation has begun, users may be eligible for a full or partial refund in accordance with the Refund Policy.

If a service has already commenced, if religious materials have already been arranged specifically for the booking, or if a pandit has already travelled to the service location, cancellation charges may apply.

Saral Pooja also reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including natural disasters, severe weather conditions, government restrictions, public emergencies, technical failures, unavailability of the assigned pandit, or other unforeseen events. In such situations, users may be offered an alternative schedule or a refund in accordance with the Refund Policy.

16. Refund Policy

Refund eligibility depends on the nature of the service booked, the reason for cancellation, the stage of service delivery, and the circumstances of the particular booking.

Where a refund is approved, it will generally be processed using the original payment method or any other suitable method permitted by applicable law and operational requirements.

The time required for the refunded amount to appear in your account may vary depending on your bank, payment provider, or financial institution. Saral Pooja is not responsible for delays caused by banks, payment gateways, or other third-party financial service providers after the refund has been successfully initiated.

Refunds may be reduced or declined where permitted under applicable law if services have already been provided, preparations have already been completed, puja materials have been purchased specifically for the booking, or where the cancellation occurred after the applicable cancellation period.

17. Donations

From time to time, Saral Pooja may facilitate voluntary donations to temples, charitable organizations, trusts, religious institutions, or other approved beneficiaries.

Unless specifically stated otherwise, donations made through the Platform are voluntary and are generally non-refundable after they have been successfully transferred to the intended beneficiary.

Saral Pooja acts only as a facilitator for such donations where applicable and does not guarantee any tax benefits, religious outcomes, or other personal benefits arising from a donation unless expressly stated.

Users are responsible for verifying donation details before completing the transaction.

18. Religious Products and Prasad

The Platform may offer religious products, puja kits, prasad, idols, books, devotional accessories, or other spiritual items either directly or through approved partners.

Product descriptions, photographs, colours, packaging, and specifications are intended to provide a general representation of the products. Actual appearance may vary due to manufacturing changes, lighting conditions, packaging updates, availability, or regional differences.

Delivery timelines are estimates and may be affected by courier services, weather conditions, festivals, public holidays, operational delays, or circumstances beyond our reasonable control.

Users should inspect products upon delivery and promptly notify customer support if they receive an incorrect, damaged, or incomplete order. Requests for replacement or refund will be handled in accordance with our applicable policies and after verification of the reported issue.

19. Promotional Offers and Discounts

Saral Pooja may, from time to time, offer promotional discounts, coupon codes, referral rewards, cashback offers, loyalty benefits, or other promotional campaigns.

Unless expressly stated otherwise, promotional offers cannot be combined with other offers and are subject to their individual terms and conditions.

Saral Pooja reserves the right to modify, suspend, withdraw, or cancel any promotional offer at any time where reasonably necessary due to operational requirements, technical issues, suspected misuse, fraud, or other legitimate business reasons.

If we reasonably determine that a promotional offer has been misused, obtained fraudulently, or applied in violation of its applicable terms, we may cancel the benefit, recover any wrongly obtained discount, or suspend the associated account.

All promotional decisions made by Saral Pooja in accordance with the published terms of the relevant offer shall be final, subject to applicable law.

20. Intellectual Property Rights

All content available on the Saral Pooja Platform, including but not limited to the application design, website layout, logos, trademarks, trade names, graphics, icons, images, videos, audio, text, articles, blogs, devotional content, software, source code, databases, user interface, and other materials, is owned by or licensed to Saral Pooja and is protected under applicable intellectual property laws.

Your use of the Platform does not transfer any ownership rights to you. You are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform solely for your personal and non-commercial use in accordance with these Terms.

You must not copy, reproduce, modify, publish, distribute, sell, sublicense, reverse engineer, decompile, scrape, create derivative works from, or otherwise exploit any part of the Platform or its content without the prior written permission of Saral Pooja.

Any unauthorized use of our intellectual property may result in legal action, including claims for damages, injunctions, or any other remedies available under applicable law.

21. User Content

Certain features of the Platform may allow you to submit reviews, ratings, feedback, photographs, videos, testimonials, comments, suggestions, or other content.

You remain the owner of the content that you submit. However, by submitting such content through the Platform, you grant Saral Pooja a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, publish, display, adapt, translate, distribute, and otherwise use such content for operating, promoting, improving, and marketing the Platform.

You represent and warrant that any content submitted by you belongs to you or that you have all necessary rights and permissions to submit it. You further agree that your content will not infringe the rights of any third party or violate any applicable law.

Saral Pooja reserves the right, but not the obligation, to review, edit, refuse, or remove any user content that is unlawful, misleading, offensive, abusive, defamatory, fraudulent, obscene, infringes intellectual property rights, violates these Terms, or is otherwise considered inappropriate.

22. Reviews and Ratings

We encourage users to provide honest and constructive reviews about their experience with our Services.

Reviews should reflect your genuine experience and should not contain false information, abusive language, personal attacks, discriminatory remarks, confidential information, promotional content, spam, or any material that violates applicable law.

Saral Pooja may moderate, remove, or decline to publish reviews that violate these Terms or that appear to be fraudulent, manipulated, or intended to mislead other users.

Reviews submitted by users represent their personal opinions and do not necessarily reflect the views of Saral Pooja.

23. Prohibited Activities

To maintain a safe and trustworthy Platform, users must not engage in activities that interfere with the operation of the Services or the rights of others.

Without limitation, you agree that you will not:

• Use the Platform for any unlawful, fraudulent, or deceptive purpose.
• Create fake bookings or provide false information.
• Attempt to access another user's account without authorization.
• Interfere with the security or functionality of the Platform.
• Introduce viruses, malware, ransomware, or any harmful software.
• Attempt to reverse engineer, copy, scrape, or extract data from the Platform without authorization.
• Use automated tools, bots, or scripts to access the Platform unless expressly permitted.
• Circumvent security measures or technical protections.
• Harass, threaten, intimidate, or abuse employees, pandits, service providers, or other users.
• Engage in activities that may damage the reputation, goodwill, or operations of Saral Pooja.

Violation of these Terms may result in suspension or permanent termination of your account, cancellation of bookings, legal action, and any other remedies available under applicable law.

24. Suspension and Termination

Saral Pooja reserves the right to suspend, restrict, or terminate your access to the Platform at any time if we reasonably believe that you have violated these Terms, misused the Platform, engaged in fraudulent activity, provided false information, failed to comply with applicable laws, or created a risk to the security or integrity of the Platform.

Where reasonably practicable, we may notify you before taking such action. However, immediate suspension or termination may occur without prior notice where necessary to protect users, service providers, Saral Pooja, or comply with legal obligations.

Termination of your account does not automatically cancel any outstanding payment obligations, nor does it affect any rights or liabilities that arose before termination.

You may also stop using the Platform at any time by discontinuing use of the Services and requesting deletion of your account in accordance with our Account Deletion Policy.

25. Disclaimer of Warranties

Saral Pooja provides the Platform and its Services on an "as available" and "as is" basis, to the extent permitted by applicable law.

While we make reasonable efforts to provide reliable Services, we do not guarantee that the Platform will always be uninterrupted, error-free, secure, or available at all times. Temporary interruptions may occur due to maintenance, technical issues, network failures, third-party service disruptions, festivals, government restrictions, or circumstances beyond our reasonable control.

Religious services offered through the Platform are based on traditional customs, practices, and the expertise of individual service providers. Religious beliefs and practices may vary between regions, traditions, temples, and individual pandits. Saral Pooja does not guarantee any specific spiritual, religious, emotional, financial, medical, personal, or supernatural outcome from any puja, ritual, consultation, or other service booked through the Platform.

Information, articles, blogs, devotional content, and other materials available on the Platform are provided for general informational and devotional purposes only. They should not be interpreted as legal, medical, financial, psychological, or professional advice.

To the maximum extent permitted by applicable law, Saral Pooja disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability, except where such disclaimers are prohibited by law.

26. Limitation of Liability

To the maximum extent permitted by applicable law, Saral Pooja, its directors, employees, affiliates, partners, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Platform or the Services.

This includes, but is not limited to, loss of profits, loss of business opportunities, loss of goodwill, loss of data, service interruptions, booking delays, cancellation of services, technical failures, or any other financial or non-financial losses resulting from circumstances beyond our reasonable control.

Saral Pooja acts as a technology platform that facilitates bookings between users and verified service providers. While we make reasonable efforts to maintain service quality, we cannot guarantee that every service will meet each user's personal expectations or preferences. Individual religious practices, customs, and traditions may vary, and differences in rituals or methods performed by a pandit shall not by themselves constitute a deficiency in service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

27. Indemnification

You agree to indemnify, defend, and hold harmless Saral Pooja, its directors, employees, affiliates, licensors, partners, and service providers from and against any claims, demands, actions, proceedings, liabilities, damages, losses, penalties, costs, or expenses, including reasonable legal fees, arising out of or relating to:

• Your violation of these Terms.
• Your misuse of the Platform.
• Information or content submitted by you.
• Your violation of any applicable law.
• Your infringement of the rights of any third party.
• Any fraudulent, negligent, or unlawful activity carried out through your account.

This obligation will continue even after your account is suspended, terminated, or deleted to the extent permitted by applicable law.

28. Force Majeure

Saral Pooja shall not be responsible for any delay, interruption, failure, or inability to provide the Services where such delay or failure results from circumstances beyond our reasonable control.

These circumstances may include natural disasters, floods, earthquakes, storms, fires, pandemics, epidemics, public health emergencies, acts of God, war, terrorism, civil unrest, strikes, labour disputes, government actions, internet failures, power outages, transportation disruptions, technical failures, cyberattacks, or any other event that could not reasonably have been anticipated or prevented.

Where reasonably possible, we will make efforts to resume the affected Services, provide updates, reschedule bookings, or offer appropriate alternatives.

29. Privacy

Your privacy is important to us. The collection, use, storage, processing, and sharing of your personal information are governed by the Saral Pooja Privacy Policy.

By using the Platform, you acknowledge that you have read and understood the Privacy Policy and consent to the handling of your personal information as described in that document.

If there is any inconsistency between these Terms and the Privacy Policy regarding the processing of personal information, the Privacy Policy shall govern matters relating specifically to privacy and data protection.

30. Third-Party Links and Services

The Platform may contain links to third-party websites, applications, payment gateways, maps, communication services, social media platforms, or other external resources for your convenience.

These third-party services are operated independently from Saral Pooja. We do not control their content, security practices, privacy policies, availability, or terms of use.

Your interactions with any third-party website or service are governed solely by the terms and privacy policy of that third party. We encourage you to review those policies before providing any personal information or completing any transaction.

The inclusion of a third-party link on the Platform should not be interpreted as an endorsement, recommendation, or guarantee by Saral Pooja.

31. Electronic Communications

By creating an account or using the Platform, you agree to receive communications from Saral Pooja through electronic means, including email, SMS, WhatsApp, push notifications, in-app messages, or other digital communication channels.

These communications may include booking confirmations, payment receipts, invoices, service reminders, account verification messages, security alerts, customer support responses, policy updates, and other information necessary for providing the Services.

Electronic communications sent by Saral Pooja shall satisfy any legal requirement that such communications be made in writing, to the extent permitted under applicable law.

32. Compliance with Applicable Laws

Users agree to use the Platform in accordance with all applicable local, state, national, and international laws and regulations.

You agree not to use the Platform for any activity that is unlawful, fraudulent, misleading, harmful, or inconsistent with the purpose of the Services provided by Saral Pooja.

If any government authority, court, or regulatory body requires Saral Pooja to disclose information or restrict access to the Platform in accordance with applicable law, we may comply with such requirements without incurring liability to the extent permitted by law.

33. Service Modifications

Saral Pooja continuously works to improve its Platform and Services. Accordingly, we may add new features, modify existing services, discontinue certain offerings, introduce new technologies, or update the functionality of the Platform from time to time.

While we aim to provide advance notice of significant changes whenever reasonably practicable, certain modifications may need to be implemented immediately due to technical, operational, security, or legal reasons.

Continued use of the Platform after such modifications become effective constitutes your acceptance of the updated Services and any corresponding changes to these Terms.

34. Dispute Resolution

Saral Pooja values customer satisfaction and encourages users to contact our customer support team before initiating any formal legal proceedings. Most concerns relating to bookings, payments, refunds, or services can often be resolved quickly through our grievance resolution process.

If a dispute cannot be resolved through mutual discussions, the parties agree to attempt to resolve the matter in good faith before pursuing any other legal remedy.

Nothing in these Terms prevents either party from seeking any remedy available under applicable law where such remedy cannot legally be restricted or waived.

35. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of India.
